Teacher says he can't be sued because he only pursued student outside of school

A former math teacher admits to having sex with a 14-year-old Queens student but says he shouldn't be able to be sued over it in federal court -- because he always treated her like just another pupil when they were in class.

Julio Cesar Benavides was 27 and teaching at Richmond Hill HS in Queens when his "personal relationship with [the student] evolved from a normal teacher-pupil relationship into a friendship and eventually into a romantic relationship," with the teen becoming "his girlfriend," according to court papers.

Benavides wound up losing his job and serving nearly two years in state prison after pleading guilty in 2007 to having unlawful sex with the girl -- whom he continued to see after his arrest, records show.

The girl's mother filed a $3 million lawsuit against the ex-teacher in Brooklyn federal court, charging that the teen's civil rights were violated because she was subjected to sexual harassment, a hostile environment and sexual discrimination at the hands of a teacher acting in his official capacity.

But Benavides, who is acting as his own lawyer, responded in court papers last week that because their "secret romantic and sexual relationship" took place after school hours and off school grounds, he can't be sued for his actions.

He says he didn't violate the girl's rights -- but even if he did, he didn't do it in his official capacity as a teacher.

"My official interactions with [her] were always legitimate," Benavides wrote to the judge.

"Never did I change her grade without there being valid academic reasons . . . I always treated her just like I treated all the other students," he wrote.

But the mother's lawyer, Charles Whittier, scoffed at that notion.

"My client was raped -- she was taken advantage of -- and Mr. Benavides was convicted of that," Whittier said. "Mr. Benavides is liable for all civil wrongdoings he committed against my client."

The suit also names the city and the Department of Education, but city officials declined to comment.

Efforts to reach Benavides were unsuccessful.

Casey Anthony Halloween Mask?! WTF

Will the Casey Anthony costume be all the rage this Halloween? If the bidding frenzy over a single Casey Anthony mask on eBay is any indication, then then answer is a resounding “yes.”

The disturbingly life-like mask was part of a film shoot, and the prop was crafted by an artist that goes by the name “Torro” according to the listing, and seller “prophunter” thinks the mask is more horrifying than anything, saying, “Forget Freddy, Jason, Meyers, here’s your chance to scare the *#&% out of everyone and win every costume contest,” adding, “No matter what your opinion of the trial is, this is still one heck of a conversation piece. I bet Nancy Grace would love one of these.”

Nancy Grace may be one of the ones bidding — the current bid for the mask is over $1,000 at the time of this writing.

The auction description says the mask is one of only 9 made, and declares it to be a “significant piece of crime history” after Anthony’s widely publicized trial for the murder of her daughter Caylee. Anthony was acquitted of all charges related to Caylee’s death beyond four counts of lying to police.

So if you want to be the talk of your Halloween party this year go ahead and place a bid — but be warned, looking like Casey Anthony can have some unexpected consequences.

T-Pain Sues Auto-Tune Inventor Over Use of His Voice

Ah, auto-tune, the popular vocal effect used by producers to correct a singer's pitch. It's impossible to turn on modern hip-hop radio these days without hearing it. Now T-Pain, the R&B singer and producer widely credited with popularizing auto-tune, is suing Antares Technologies, the company that first developed it.

For years, T-Pain and Antares enjoyed a fruitful business relationship that gave modern singing a synthetic shine and drove vocal purists absolutely nuts. But T-Pain has formed a new company, Izotope, and intends to promote his own voice-manipulation product called "The T-Pain Effect."

So he's suing Antares in order to distance himself from the company.

According to a complaint filed Monday in U.S. District Court in California and first revealed by AllHipHop.com, T-Pain claims Antares continues to use his image and likeness in advertisements, packaging and marketing materials. The singer/producer believes that the continued implication of an endorsement will confuse and mislead the public and damage sales for his own new technologies, including the "I Am T-Pain Mic."

The guy who did more than anyone to let singers sound not like themselves now is demanding an injunction to prevent Antavares from using his name, photograph, likeness, and oh yes, his voice.

Woman Kicked Off Flight, Falsely Accused Of Not Wearing Underwear

A New York City woman has filed a lawsuit against JetBlue Airlines after she was kicked off her flight and questioned about whether or not she was wearing panties.
Malinda Knowles, 27, claims that during a pre flight walk through, a JetBlue supervisor put a walkie talkie between her legs to see if she was wearing underpants.
"He said, 'I don't want to see your panties or anything but do you have any on?'" Knowles recalled yesterday."I didn't want to show him anything. He wanted me to basically show him my crotch. I was completely humiliated. It was vulgar. It was macho. It was rude."
According to Knowles, she was escorted off the plane and forced to prove that she was wearing shorts under her baggy shirt. After the confirmation, she returned to the plane only to be told the pilot would not fly with her on the plane.
"He said, 'The captain is refusing to fly you today. We need to remove you from the flight,'" said Knowles.
She was forced to take a later flight which delayed her departure by four hours.
"I really feel like the guy just wanted to demean me in some way," she said.
Knowles is seeking unspecified damages in the civil suit which accuses the airline worker of assault and battery and intentional infliction of emotional distress.

Man Says Lil Boosie Paid Him $15G's To Kill Rapper Nussie

Prosecutors have accused rapper Lil Boosie of paying $15,000 to have rival rapper Christopher “Nussie” Jackson murdered.

Prosecutors played a videotaped statement from Michael “Marlo Mike” Louding in court this week.

Louding confessed to detectives that Lil Boosie wanted Nussie killed, after the rapper was allegedly disrespectful to one of Lil Boosie's associates during an altercation.

According to The Advocate, Lil Boosie hired Louding and another associated named Michael “Ghost” Judson to murder Nussie, as well as another man named Terry Boyd.

Only Michael Louding is on trial for the murder of Christopher “Nussie" Jackson, because Judson is dead.

Louding's trial for murdering Nussie is just the start, as he has been charged with five other murders between 2009 and 2010.

Rapper Lil Boosie, born Torrence Hatch, is also charged with first-degree murder in one of the killings.

Prosecutors claim to have evidence that Lil Boosie hired Louding to shoot a man named Terry Boyd in October of 2009.

Lil Boosie, 28, was not charged in the death of Christopher “Nussie” Jackson, because he did not have direct contact with Michael Louding prior to Nussie's murder.

Earlier this week, Lil Boosie was accused of attempting to smuggle drugs into a second state prison in Louisiana.

The rapper was indicted for trying to smuggle codeine into Angola State Prison, as well as the Dixon Correctional Institute at Jackson, where he was previously incarcerated, while serving a 10-year sentence for possession of marijuana.

Prosecutors are still debating if they are going to seek the death penalty against Lil Boosie.

LA Traffic Officer Appears In Porn Film, Loses Job

A Los Angeles traffic officer was fired after appearing in a pornographic film while on duty and wearing his uniform, officials confirmed Thursday.

John K. Dancler was discharged Monday under charges of misconduct, after serving 23 years with the Department of Transportation.

The Los Angeles Times reported that Dancler challenged his discharge by filing an appeal with the Civil Service Commission.

The Commission's executive director, Bruce Whidden, told The Times that the 2008 acts were classed as "indecent," and portrayed the force in an unflattering way.

Dancler was shown "groping the bare breasts, spanking the bare buttocks and being straddled by an adult video actress in public," Whidden said.

However, the traffic officer's lawyer, Bobby Samini, claimed Dancler was being turned into a "scapegoat" and that firing his client was unfounded. He warned the firing could end in a lawsuit.

Foxy Brown broke the news during an interview with the New York Post on Sunday (July 17th).

NFL legend Michael Irvin a passionate Out advocate for gay rights, marriage equality

Michael Irvin, the macho, God-fearing NFL Hall of Famer from Fort Lauderdale, appears this month — shoulder pads on, shirt off and pants yanked below his waistline — on the cover of Out magazine, in a profile about his unwavering support for gay rights.
“Until we do that, we’re going to be stuck in the Dark Ages about a lot of things. When a guy steps up and says, ‘This is who I am,’ I guarantee you I’ll give him 100% support,” he tells journalist Cyd Zeigler in the Out profile titled “Michael Irvin: The Playmaker Preaches.”
Irvin, 45, learned about gay people early in life, when as a youngster he saw his older brother Vaughn walking from the family home wearing women’s clothing.
Irvin couldn’t believe his eyes. He turned to his father. “My dad looked back at me and said, ‘Yes, that’s your brother. And you love your brother,’” Zeigler writes in Out.
Zeigler, who co-founded the website Outsports.com, said he became a frequent guest on Irvin’s radio program, now on WQAM 560 in Miami, about three years ago.
“Michael and I became friends,” Zeigler told The Miami Herald on Tuesday. “Over time, he started revealing things and told me about his brother a few years ago, in a hush-hush way. As friends.”
A few months ago, Irvin mention on the program, “in passing,” that his late brother was gay, Zeigler said.
Zeigler suggested that he write a full profile of Irvin’s experience with his brother, who died in 2006 of stomach cancer at age 49.
“He said absolutely. It’s time to talk about my brother,” Zeigler recalled.
Irvin, the 15th of 17 children, told Zeigler that he idolized Vaughn. “He was the smartest, most charismatic man I’d ever seen in my life,” said Irvin, a football star at the University of Miami before joining the Dallas Cowboys.
As a younger man, Irvin was uncomfortable talking about Vaughn. He feared that anyone would think he was gay, too.
Irvin's comfort level has evolved. As a younger man, he never would have had the guts to appear on a show like Dancing With the Stars, he told Zeigler.
And he certainly wouldn’t have posed provocatively for a gay magazine like Out.
“Michael, as soon as he showed up at the photo shoot, he immediately put on the shoulder pads and took off his shirt. Nobody asked him,” Zeigler said. “I said you don’t have to do this. He said this is what I want I do. He’s pulling down his pants, his underwear is showing. He just ate it up. He loved it.”
Now, Irvin says he supports marriage equality for same-sex couples, Zeigler said. “He’s truly committed to this cause. He really wants people to live their lives.”
Irvin’s tumultuous personal life, including a 1996 arrest for cocaine possession and being accused several times of sexual assault, helped bring him around, Zeigler said.
“One of the things he said to me in the past was going through all the trouble, including legal trouble, he can’t condemn other people,” Zeigler said. “No matter who you are, he doesn’t feel he is in a position to condemn anybody. As a Christian, he feels its unchristian to do it.”

Man's penis cut off, put in garbage disposal

GARDEN GROVE, Calif. - Authorities said Tuesday that a woman is in custody after she drugged her estranged husband, tied him to a bed, cut off his penis with a large knife and threw it down a garbage disposal.

Police Lt. Jeff Nightengale said 48-year-old Catherine Kieu Becker drugged a meal and fed it to the 51-year-old victim, whose name was not released, shortly before the attack Monday night.

Nightengale said the man felt sick, went to lie down and lost consciousness. He said Becker then tied the victim's arms and legs to the bed with rope and attacked him with the 10-inch knife as he awoke.

"He was conscious when his penis was removed," Nightengale said.

He said Becker then put the penis in the garbage disposal and turned it on.

Nightengale said Becker called 911 to report a medical emergency and acknowledged the crime to responding officers.

The victim was found tied to the bed, bleeding profusely.

Bail for Becker was set at $1 million after she was booked for investigation of aggravated mayhem, false imprisonment, assault with a deadly weapon, administering a drug with intent to commit a felony, poisoning and spousal abuse.

The victim underwent surgery and was in serious condition at the University of California at Irvine Medical Center in Orange.

Becker is due in court Wednesday. A telephone listing for her residence could not be located.

The couple was reportedly in the process of a divorce.

A call to the hospital was not immediately returned.

Michigan Woman Sues For A Broken Heart After Facebook Relationship Breakup

A woman in Michigan wants more than $8,000 from a man she blames for breaking her heart - over Facebook.

Cheryl Gray, a 50-year-old unemployed paralegal, charged in a lawsuit that Wylie Iwan led her on over the course of an online relationship which began while playing "Mafia Wars" on Facebook, the Tri-City Herald reported.

She said they seemed to be smitten -- until after she sent him gifts and booked a trip to visit the 35-year-old Applebee's server at his Seattle home.

A week before she was supposed to visit, her online Romeo dropped a heartbreaking bomb: he met another woman in a bar.

"I feel foolish," Gray told the Tri-City Herald. "I'm not so much mad or angry. I feel foolish. I am disillusioned."

She told the newspaper that they talked on the phone, texted each other and emailed over the course of the friendship.

During their conversations, she said that Iwan used the words "I'm falling in love with you," according to the paper.

Iwan, who called the lawsuit "frivolous," denies ever being anything more than friends with her.

He said that she seemed fine after he told her he met someone - until she started a Facebook group calling him a predator, the paper reported.

He said at first, Gray seemed like a cool person. But he never meant to lead her on.

"We decided - it wasn't all me - but we decided we wanted to meet each other. After that, things started toward a relationship and we started sharing more information," Iwan said.

"For Valentine's Day, she said she wanted to tell me she loved me as a friend. I told her I love her, too. I was meaning it as a friend."

Iwan isn't the first person to be sued over a broken heart.

In 2009, Kris Shubert sued her ex-boyfriend Kurt Wiksten after she moved to Texas to be with him and their relationship ended.

With a full cross-country move and a broken promise of a ring on her finger, Shubert wanted much more than a few thousand, the Daily Business Review reported.

She put her heartbreak at $1 million.

pimp c's wife not happy about rap- A -lot records releasing a new pimp c album

Pimp C’s wife Chinara Butler wants to make one thing clear, and that is the fact that she does not like the selection of music Rap-A-Lot has chosen for her late husbands upcoming album. In an interview, she opened up about why she is unhappy, and about preserving her husbands image in the manner he would want it to be:
“I want to make sure everyone understands that with those songs and my whole issue is that, I don’t feel like we should try to do something new with Chad’s music, if he didn’t do it,” Chinara Butler explained to AllHipHop.com. “To me its not right and clearly I’m not feeling it. Just like the songs, I’m not feeling a lot of the singles.”
With both sides seeking legal counsel, Chinara stresses that it is a lack of communciation that has brought her and the record label to a crossroads:
“I think its been about three years or so since we [Rap-A-Lot CEO James Prince] had contact and we got together and we talked about what he wanted to do and what I wanted to do,”
Another issue is a lack of payment, and protecting her husbands legacy:
“I’m being sued when you [Rap-A-Lot] are putting out a project and I haven’t even received any money or anything from? I will never amend anything,” Chinara Butler told AllHipHop.com. “This is about him [Pimp C.] and all I can do is make him proud and make sure no one tarnishes his legacy, and what he built his whole life…I just think its sad.”
And another thing she made clear is that this has nothing to do with Pimp’s like time rap partner, Bun B, and that she is working on an event for breast cancer in October with his wife.

DMX Home Early Next Week; Reps Say Drug Reports Exaggerated

Reps for incarcerated rapper DMX have come forward to dispute recent allegations that have surfaced regarding his most recent stint behind bars.

A representative for the rapper told AllHipHop.com that the reports of his sneaking drugs into prison were exaggerated, and that most of the infractions took place months ago, one as far back as January.

The rep said that the information is now just hitting the press, because the rapper was transferred from one jail, to another, where officials reached guilty verdicts on several minor infractions.

The rapper was supposed to be released today (July 13th), but his release date has been pushed back to early next week as he serves the extra days and is processed for release.

“DMX never snuck anything into the prison,” a rep for the rapper told AllHipHop.com. “As far as him smoking in jail, there is an area where inmates are allowed to smoke. A guard felt that DMX was smoking outside of a designated lined area in the smoking court and started harassing him, which resulted in the charge.”

The news is just hitting the Internet, because prison officials issued verdicts on several of DMX's previous infractions, on July 5th, 2011.

“DMX is looking forward to being released from prison and resuming his career,” DMX's rep told AllHipHop.com. “We are in the early process of helping ex-rebuild his career in staying on the right track this time.”

According to reps for DMX, the rapper is planning on performing at several shows shortly after he is released from prison, and gets his personal business in order.

Barret Marson, Arizona Department of Correction spokesman confirmed DMX's release date next week.

Feds Seek To Remove Jimmy Henchman's Counsel From Drug Case

James “Jimmy Henchman” Rosemond's legal defense could become complicated, if federal prosecutors have their way.

Prosecutors are seeking to remove his counsel Jeffrey Lichtman from the case, claiming the defense lawyer presents numerous conflicts of interests in representing Rosemond.

Rosemond, who was accused of running a $10 million per year cocaine operation, is facing life in prison.

Federal prosecutors have not charged Lichtman with any crime, but they believe that his close affiliation to several suspects could compromise his role as defense attorney for Rosemond.

According to federal prosecutors, the Hip-Hop mogul, who handled the careers of Akon, Brandy, rapper Game, and others, paid Lichtman $150,000 in cash for legal services.

Lichtman denied a number of allegations that prosecutors presented in court, including a claim that the lawyer tried to find out if a man involved in the cocaine operation was cooperating with federal agents.

Lichtman has denied any wrongdoing and has offered to take a lie detector test.

He is still Rosemond attorney.

Rosemond is currently indicted for his role in a massive cocaine conspiracy ring, which allegedly shipped hundreds of kilos of cocaine to studios in New York and sent tens of millions in proceeds to the West coast.

Lil B Says He's Gay But Not Totally Gay

Lil B wants his detractors that claim he softened his album title by putting "I'm Happy" in parentheses to know that he did not cop out. In an interview with Brooklyn Martino, B says he wanted his fans to understand that he is straight.
"How can I cop out when in my head, I had a plan to do that?
Like, I'm not literally a homosexual, but I'm happy...I did it to also embrace the homosexual community also, but some motherf*ckers was like, I copped out, 'Ah B, you should've stuck with the 'I'm Gay' title.' I'm not totally gay, but I am gay. Salute."
The album, I'm Gay was released with no promotion on iTunes, then the based god decided to release it for free. The first week sales of the release were somewhere around 1,700 units despite the media hype surrounding the young XXL freshman.

50 Cent's Lawyers File Objection To Young Buck's Debt Repayment Plan

The Wall Street Journal reports 50 Cent's lawyers won't make things easy for Young Buck when he heads to bankruptcy court next week.Earlier this month, Young Buck and his legal team had to submit a debt repayment plan in anticipation of a June 19 bankruptcy hearing. The repayment plan is a standard document that many creditors require when a debtor decides to file for bankruptcy protection. The Wall Street Journal’s “Bankruptcy Beat” reports that 50 Cent’s legal team won’t be making things easy for the former G-Unit member.

“At a recent questioning over Young Buck’s financial affairs, 50 Cent’s lawyers said the rapper ‘had trouble identifying where he had been on tour, who had booked his travel, how he had even gotten from one place to another,’” Jaqueline Palank of the Journal reported. “This troubles creditors like 50 Cent, his lawyers wrote in court papers, because it raises the concern ‘as to whether any creditor can truly rely upon these claims and projections by the debtor.’”

The objection to Buck’s debt repayment plan was filed Monday, essentially argues that Buck has too many unanswered financial questions to put his plan into action. Another sticking point in the matter is if Buck would honor his commitment to 50’s G-Unit label. At press time, Buck was still contractually obligated to record under G-Unit Records. Previous documents stated that Buck would seek to reject the recording agreement. But more recent indications are that Buck would keep and/or modify the recording agreement, and for good reason.

“If the debtor defaults under the recording agreement, and/or rejects the recording agreement, G-Unit would maintain a claim for damages flowing to it as a result of the debtor’s failure to perform under the recording agreement in an amount believed to be not less than $10,000,000,” The Journal reports.

Ghostface Killah Sued For Using "Iron Man" Theme

Ghostface Killah is facing a new lawsuit for his use of theme song from the Iron Man series.
Killah and his label Sony Entertainment are being sued by composer Jack Urbont who claims they illegally sampled his theme song from the Marvel animated series.
Surprisingly Urbont is just now filing suit for two tracks off the rapper's 2000 album that he claims illegally samples his work.
In addition to copyright infringement, Urbont claims that Ghostface's Tony Starks moniker is too close to the super hero's real name, Tony Stark.
And although he has no present connection to Marvel  Comics, Urbont claims that Killh owes the company royalties for his illegal use of the name.

Woman Dies After Having Sex With Dog

Woman Died From Sex With Dog, Man Arrested
In what is probably the most disgusting, yet tragic story we'll report this year, a woman in Ireland died of an allergic reaction hours after having sex with a dog.
According to reports, a man has been charged with forcing his German Shepard to have sex with the woman, which broke Ireland's bestiality laws.
AOL News reports:
Sean McDonnell, the 57-year-old charged in the case, apparently ordered his German Shepard to have sex with a 43-year-old mother of four that he met in an online fetish chatroom, according to the Journal.
They met to perform the kinky act with the canine, but the woman died hours later from an attack similar to a reaction unleashed by a peanut allergy, according to the Irish Daily Star.
Although the woman perished on October 7, 2008, McDonnell was just charged in Limerick. It's an unprecedented case on the Emerald Isle where it's believed that no one's been prosecuted under the country's 1861 buggery laws, the Journal reported.
A conviction could land McDonnell in prison for life.
The Gardai, the Irish police, determined that the sex was consensual, according to an article originally published in the Irish Daily Star.

Xzibit Says Planking Is Connected To Slave Trade

Xzibit Angered By Planking Craze
If there's a reason to be upset by the planking fad that has taken the world by storm, then rapper/actor Xzibit has stumbled upon it.
Planking apparently has some visual connection to the slave trade and X to the Z took to Twitter to express his disdain for the phenomenon.
“Planking is the dumbest s**t ever. Planking was a way to transport slaves on ships during the slave trade, it's not funny. Educate yourselves.
“Don't get it twisted. I care less where your dumb a**es lay face down and take pictures of the s**t, I'm just telling you where it came from.
Camilo Smith at TheGrio.com argues that while the connection is not entirely clear, there is evidence of a relationship between planking and the transportation of slaves.
Smith mentions the book, Upon these Shores: Themes in the African-American Experience, 1600 to the Present, which lays out this graphic description:
Some ships had tiny bunks, really nothing more than shelves, on which slaves could recline; in others, the slaves lay side by side on the planking, rolling with the ship, bodies virtually touching, for weeks on end.

Waka Flocka Says He's Quitting Rap

While fans spent the following hours debating the validity of the Flocka's retirement tweet, RumorFix.com obtained an exclusive statement from the rapper's mother and manager, Debra Antney:
RumorFix has confirmed that rapper Waka Flocka Flame is quitting the music business.
Waka's mom and manager, Debra Antney, tells RumorFix exclusively, "He talking about quitting. He's sick of this. We all are."
Debra, who is the Kris Jenner of the rap world, tells us, "We're all disgusted with this stuff. You can't trust people."
She says Waka isn't touring or recording right now and that they are reestablishing their relationship as mom and son -- as opposed to manager and musician.
Prior to his retirement announcement, Flocka Flame was working on a collaboration album with Gucci Mane, Ferrari Boyz, as well as a sophomore album Triple F Life: Friends, Fans, & Family.
Despite rumors and reports, we doubt the 25-year-old rapper will actually retire.
